What the law says
IDEA mandates a Free Appropriate Public Education (FAPE) for every eligible child. Federal law promised to fund 40% of the cost it takes to educate a student (based on the national average).

Congress promised to pay 40% of the costs to educate a student (national average = $14,650 × 40% = $5,860) for every child with a disability within a district. In 2025, they delivered $1,799. The $4,061 difference is the legal commitment Congress has violated every year since 1982 — the year they were supposed to reach full funding.

Special education actually costs 2–3× general education ($27,000 per student with a disability vs. $10,000 for general ed). Nationally, Bellwether found districts spent $13,127 per SPED student in FY2020 — but received only $4,966 combined from federal and state sources. Local districts absorbed $8,160 per pupil themselves.

Wealthy districts pay for the federal shortfall through local property taxes. Poor districts cannot. Reasearch found a $4,722 gap in state special education revenue between districts forced to overspend locally and those that aren't.
